- Acceptance of Terms
This Terms of Use Agreement (“Agreement”) governs your use of The Kennedy Ladd Foundation’s website (https://kennedyladd.org) and related services (“Site”). By accessing or using the Site, applying for programs, donating, volunteering, sharing your story, or interacting in events, you agree to be legally bound by this Agreement. Please read carefully. The Foundation may amend these terms at any time via posting on the Site. - Use of Materials
All content (text, images, graphics, downloadable forms) on the Site is protected by copyright, trademark, and other intellectual property rights—owned by the Foundation or licensors. You may view and print content solely for personal, non-commercial use, provided you retain all proprietary notices. You may not copy, distribute, modify, frame, or publish content without prior written permission.

- Program Applications
Applying for or accepting items through Foundation programs constitutes acceptance of additional terms posted on the applicable program page, including usage, return, and promotional permissions (kennedyladd.org). - Electronic Communications
By providing your email address, phone number, or postal address, whether for donations, program participation, story sharing, or volunteering, you consent to receive communications from The Kennedy Ladd Foundation, including:
- SMS/Text Messages, including appointment reminders, program updates, fundraising notifications, alerts, and surveys
- Postal Mail
Message and data rates may apply. You may opt out of email by following the “unsubscribe” link, opt out of SMS by replying “STOP,” or opt out of postal mail by contacting us at Info@kennedyladd.org or PO Box 932.
- Disclaimer of Warranty
The Site and all content are provided “as is” and “as available”, without warranty of any kind. The Foundation does not guarantee uninterrupted access, error-free operation, completeness, or reliability of the Site or materials. Reliance on any information is at your own risk. - Limitation of Liability
To the maximum extent permitted by law, The Kennedy Ladd Foundation (including its officers, directors, staff, affiliates, and volunteers) shall not be liable for any damages arising out of your use of, or inability to use, the Site or content. - Third‑Party Links
The Site may include links to third-party websites for your convenience. The Foundation is not responsible for content, accuracy, practices, or privacy policies of those sites. Your use of linked sites is at your own risk. - No Framing

The Foundation reserves the right, at its sole discretion, to suspend or terminate your access to the Site or any services at any time without notice or liability. - Compliance with Laws
This Site is intended for use within the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws. - Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with Tennessee state law, without regard to conflicts-of-law principles. Any action or dispute must be brought in state or federal courts located in Tennessee. Any claim must be filed within one year after it arises. - Severability & Waiver
If any provision is found invalid or unenforceable, that provision will be struck and the remainder will remain in effect. Failure to enforce a provision does not constitute waiver.
iPad Terms & Conditions
These Terms and Conditions (“Agreement”) outline the terms and conditions governing the provision of iPads to children diagnosed with Mucopolysaccharidosis (MPS) by the Kennedy Ladd Foundation (“Foundation”). By applying for and accepting an iPad through this program, you agree to abide by the following terms and conditions:
- iPad Ownership and Usage
1.1. The iPad provided by the Kennedy Ladd Foundation is intended solely for the use of the child with MPS for educational and recreational purposes.
1.2. You agree not to sell, transfer, or assign the iPad to any other individual or entity.
1.3. The iPad remains the property of the Kennedy Ladd Foundation and may be reclaimed if any of the terms and conditions of this Agreement are violated.
- Return Policy
2.1. If the iPad is no longer needed by the child with MPS, you must promptly contact the Kennedy Ladd Foundation to arrange for its return.
- Promotion and Marketing
3.1. By accepting the iPad, you grant the Kennedy Ladd Foundation permission to use any information and pictures provided by you or associated with the iPad for promotional purposes. This includes, but is not limited to, using such information and pictures on the Foundation’s website, social media platforms, and other marketing materials.
- Revocation of iPad
4.1. The Kennedy Ladd Foundation reserves the right to revoke the iPad if it is determined that you have falsely applied for an iPad or if you do not have a child with MPS in need of the device.
- Privacy
5.1. Any personal information and data shared with the Kennedy Ladd Foundation will be treated in accordance with the Foundation’s privacy policy and applicable laws and regulations.
- Liability
6.1. The Kennedy Ladd Foundation is not liable for any damages, losses, or injuries arising from the use or possession of the iPad provided under this program.
- Governing Law
7.1. This Agreement is governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law principles.
- Amendments
8.1. The Kennedy Ladd Foundation reserves the right to amend or modify these terms and conditions at any time. Any changes will be communicated to you in writing or through the Foundation’s official communication channels.
By accepting the iPad provided by the Kennedy Ladd Foundation, you acknowledge that you have read, understood, and agreed to comply with the terms and conditions outlined in this Agreement. Failure to adhere to these terms and conditions may result in the revocation of the iPad and any legal action deemed necessary by the Foundation.
